Scope & acceptance

This Privacy Policy ("Policy") is issued by Andrei Bandarenka, registered at Seredina St. 2, Retchica, 247500, Republic of Belarus (the "Developer," "we," "us"), the developer of the Food Calorie Tracker & AI Plan application (the "Application") distributed on Google Play. The developer name, address, and contact details on this page are provided so that they match the information in the Application's Google Play Console listing and Data safety section.

This Policy applies to the Application, including its calorie and meal tracking features, photo-based food logging, in-app AI assistant chat, generated meal and exercise plans, and any auto-renewing subscription plans, as well as to disclosures shown inside the Application. It is available at all times from a public URL and from within the Application itself.

By downloading, installing, or using the Application, you agree to the collection and use of information as described in this Policy. If you do not agree with these terms, please do not use the Application.

Information we collect

2.1 Profile & goal information

To calculate your daily calorie target and build a personalized plan, we ask for information such as your age, sex, height, current weight, activity level, dietary preferences, and fitness or weight goals. You choose what to share; some fields are required for the Application's core calculation features to work.

2.2 Food logs & meal photos

When you log a meal, the Application stores the food items, portion sizes, and calorie/macronutrient values you enter or confirm. If you use the photo-logging feature, the picture you take or select is analyzed — using on-device and/or cloud-based image-recognition technology — to suggest what food is shown and estimate its nutritional content. Photos you submit for this purpose are processed as described in Section 5.

2.3 AI assistant conversations

Messages you send to the in-app AI assistant, and the assistant's replies, are processed to answer your questions and generate personalized suggestions. Depending on what you choose to share, these conversations may include dietary, weight, or other health-related details you volunteer. See Section 5 for how this is handled.

2.4 Generated plans & reports

Based on the information above, the Application generates personalized meal plans, exercise suggestions, and progress reports. These generated outputs are stored in your account so you can revisit them.

2.5 Device, diagnostics & usage data

  • Device model, operating system version, app version, and language settings;
  • Crash logs and performance diagnostics;
  • Aggregated, pseudonymous usage analytics (e.g., which features are used) to help us fix bugs and improve the Application.

2.6 Subscription & purchase data

Premium features and the AI plan are offered as auto-renewing subscriptions billed through Google Play Billing. We receive your subscription status, plan/tier, and purchase token, but never your card number or full billing details, which Google Play handles directly.

2.7 Health Connect — optional

If the Application offers the option to connect to Health Connect by Android, and you choose to enable it, we may read data such as steps, active energy, or body weight, and/or write data you log in the Application back to Health Connect, solely to keep your records in sync. This only happens with your explicit permission through the Health Connect permissions screen, which you can review or revoke at any time from Android Settings → Security & privacy → Privacy → Health Connect (or the Health Connect app). Data obtained through Health Connect is never used for advertising or shared with advertising or data-broker third parties.

Permissions used by the app

Android requires apps to declare the runtime permissions they use. The table below explains why the Application typically requests each one. The exact set shown to you may vary by device and Application version — the current list is always shown on the Application's Google Play listing under "App details."

Purposes & legal basis

We process the information above only to:

  • Provide the Application's core functionality — calorie/macro calculations, food logging, and photo-based food recognition (performance of our agreement with you);
  • Power the in-app AI assistant and generate your personalized meal and exercise plans (performance of our agreement with you, based on your explicit input);
  • Process and manage subscriptions purchased through Google Play (performance of a contract);
  • Diagnose crashes, fix bugs, and improve the Application (our legitimate interest);
  • Understand aggregated feature usage (legitimate interest, or consent where required by your local law);
  • Comply with applicable legal and accounting obligations (legal obligation).

Where dietary, weight, or other health-related information is involved, our legal basis is your explicit consent — see Section 5.

Health data, AI processing & your consent

Calorie, weight, dietary, and fitness-goal information can be considered health or "sensitive" data under laws such as the EU/UK GDPR, the California Consumer Privacy Act, and U.S. state consumer-health-data laws. We handle it accordingly:

  • We ask for your explicit, separate consent before we process health-related information or send a food photo or chat message to an AI service, shown the first time you use those features.
  • We never use your health, dietary, or fitness data for advertising, marketing, or other use-based data mining, and we never sell it to data brokers.
  • You can withdraw your consent at any time from the Application's privacy settings; withdrawing consent will disable the AI and photo-recognition features but not the rest of the Application.

Third-party AI & image-recognition providers

To power the AI assistant chat and food-photo recognition, the Application sends the relevant photo or message text to our AI infrastructure providers strictly to generate a response for you. These providers process that content under contractual confidentiality and data-protection terms with us, and we do not permit them to use your inputs to train models for their own or any other customer's benefit beyond what is necessary to deliver the feature to you.

If you would rather not have a specific photo or message sent to an AI provider, simply avoid using the AI chat or photo-recognition features — you can still log meals and calories manually.

AI-generated content

Meal plans, exercise suggestions, and other content produced by the AI assistant are automatically generated and are labeled as AI-generated inside the Application. This content is for general informational purposes only, is not medical advice, and does not replace guidance from a doctor, registered dietitian, or other qualified healthcare professional.

How we share information

We do not sell your information and do not share it with data brokers or advertising networks. Limited data is shared only with service providers that help us run the Application, under their own confidentiality and data-protection terms:

  • Google LLC / Google Ireland Ltd. — Google Play Billing, Google Play services, and Health Connect, only if you connect it;
  • AI & image-recognition infrastructure providers — process food photos and chat messages solely to generate the AI assistant's responses, as described in Section 5;
  • Analytics & crash-reporting providers — receive aggregated, pseudonymous diagnostic and usage data to help us maintain app quality.

We may also disclose information where required to comply with a legal obligation, court order, or valid governmental request, or to protect the rights, property, or safety of our users, the public, or ourselves.

Data retention

Your profile, food logs, generated plans, and AI conversation history are retained for as long as your account is active, so the Application can show your history and progress. If you delete your account (Section 10), this data is deleted or anonymized within a reasonable period, except where we must keep limited records to comply with legal, tax, or accounting obligations. Diagnostic and analytics data is retained no longer than reasonably necessary, typically within 14 months of collection.

Data security

We take reasonable legal, organizational, and technical measures designed to protect your information from unauthorized or accidental access, loss, alteration, or disclosure, including encryption in transit, restricted access to stored data, and reliance on providers (such as Google Play and our AI infrastructure partners) who maintain their own industry-standard security programs. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

Subscriptions & cancellation

Paid plans are billed and managed entirely through Google Play Billing. Unless canceled, subscriptions renew automatically at the price and interval shown at the time of purchase. You can review, change, or cancel your subscription at any time from Google Play Store → Menu → Subscriptions, generally at least 24 hours before the renewal date to avoid being charged for the next period. Refunds are handled under Google Play's own refund policy, as we do not process payments directly or store your payment credentials.

Account & data deletion

You can permanently delete your account and associated data directly inside the Application, from Settings → Account → Delete Account. In line with Google Play's requirements, you can also request deletion without reinstalling the Application: simply email melisa.moory@gmail.com from the address associated with your account, and we will confirm once the deletion is complete.

Children's privacy

The Application is a general-audience health and fitness tool and is not directed at children under 13 (or the minimum age defined by your local law, or the Application's Google Play content rating if higher). The Application is not designed for or marketed to children, and is not listed under Google Play's Families program. We do not knowingly collect personal or health information from children. If you believe a child has provided us with information, please contact us at melisa.moory@gmail.com and we will take steps to delete it.

Your privacy rights

To exercise any of the rights below, contact us at melisa.moory@gmail.com; we will respond within the timeframe required by applicable law (generally within 30 days).

If you are in the European Economic Area or the United Kingdom (GDPR/UK GDPR)

  • Right to access, rectify, or erase your data, and to restrict or object to processing;
  • Right to data portability;
  • Right to withdraw consent at any time — including consent for health-related and AI processing — without affecting prior processing;
  • Right to lodge a complaint with your local data protection supervisory authority.

If you are a U.S. resident (CCPA/CPRA and state consumer health-data laws)

  • Right to know what personal information — including health information — is collected, used, or disclosed;
  • Right to request deletion or correction of your personal information;
  • Right to opt out of the "sale" or "sharing" of personal information — we do not sell or share personal or health information for cross-context behavioral advertising, and we do not use geolocation to target ads around health-related locations;
  • Right to withdraw consent for the collection or processing of consumer health data at any time;
  • Right to non-discrimination for exercising any of these rights.

If you live elsewhere, we will honor equivalent rights available to you under the law of your country on a reasonable, good-faith basis.

International data transfers

The Developer is based in the Republic of Belarus, and our service providers (including Google Play and our AI infrastructure partners) operate global infrastructure. As a result, your information may be processed in countries other than your own, including countries with different data protection laws. Where required, such transfers rely on appropriate safeguards, such as standard contractual clauses or the relevant provider's own compliance mechanisms as a data processor under the GDPR.

Changes to this Policy

We may update this Policy to reflect changes in the Application, our practices, or legal requirements. The "Effective" date at the top of this page shows when it was last revised. For material changes — particularly any change to how health-related or AI data is used — we will provide additional notice, such as an in-app prompt asking you to review and re-confirm your consent. Your continued use of the Application after a new version is posted means you accept the revised Policy.

Governing law

This Policy is governed by the laws of the Republic of Belarus, the Developer's country of registration, without prejudice to any mandatory consumer-protection or data-protection rights you have under the law of your own country of residence (for example, the GDPR if you are in the EEA/UK, or applicable state law if you are in the United States), which continue to apply where required.
